RE: Response to your request to initiate the grievance process


Dear Jane,


On May 30, 2000, Marty Hiller found your handwritten note to him dated on May 26, 2000 in his mailbox, requesting to initiate the grievance process. Marty has shared the note with me. We found your note surprising given that we have been working and communicating with the employees and volunteers who have been acting on your behalf since your termination. As you know, your supporters have developed a website and initiated a letter-writing campaign to which all the Trustees have received numerous letters and emails. Several articles, as well as letters to the editor, have been published, presumably with your approval and support, in the Free Times and Scene magazines regarding your termination. In all these numerous communications, your supporters and agents have requested your reinstatement to the Free Clinic.


Consequently, and based upon a request from your agents, we canceled the agenda for our regular Board meeting and held a special Board meeting on May 31st, at 6:00 p.m. We listened to the numerous requests for your reinstatement by your agents and supporters. This is consistent with the ultimate and final step in the grievance procedure, step 4, where the decision of the Board of Trustees is considered final.


As you know, the policy and purpose of the employee handbook is stated in Section 1, which states in pertinent part:


"This Handbook is not meant to cover every contingency. Instead, it is designed to serve as a tool for orientation and a guide and resource for everyone. On occasion, situations arise that call for administrative interpretation of these rules. We pledge that every effort will be made to ensure that such decisions are made systematically, fairly, and impartially."


Based upon that provision, and the fact that we received your request to initiate the grievance process one day before the special Board meeting, initiated by your agents and supporters, the Board agreed to grant your request to initiate the grievance procedure immediately at the step 4 Board level, since the decision of the Board is final for all grievances.


Consequently, at our May 31st Board meeting, the entire Board carefully considered all the issues brought forward on your behalf by your agents; namely, their belief your termination was unfair and illegal, and their request for your reinstatement. These are the identical issues raised in your May 26th request. After carefully considering all the issues brought forth on your behalf by your agents and supporters, the numerous letters, emails, faxes and articles written on your behalf, we have determined that your termination was legal and fair, and was based upon your insubordination and failure to follow the directives of your supervisors.


Thus, this letter is your written notification that the Board is denying your request for reinstatement and a specific acknowledgment from the Board that your termination was legal, fair and just.

Does the board really think this is going to make everything stop? The efforts of the volunteers and staff to weed out the corruption and return the Free Clinic to the PEOPLE will continue and strengthen!

Maybe Mr. Fishman wouldn't suck up so much if he didn't have such a large stake in the new building project. He's being about as above board about that as he is with our current situation. The man is a coward.

When I presented to the Board with the other three volunteer "representatives", I was speaking for myself and the volunteers who have been participating in our activities. I did not and do not speak for Jane. Or other staff members. Nor did I, nor will I, speak for the community. I am a volunteer and so only for volunteers will I speak, with their approval. I have no idea how the board got the idea we were agents of Jane's. That's absurd. We never said that. They never mentioned this was to be a grievance hearing... Incredible.

I am quite dismayed with the boards response to Jane.

We will certainly have to clarify this for the board. Maybe we need to seek legal counsel as well....

Once again, the shame that I feel about the people that are "legally responsible" for the Free Clinic is total and immense.

What must the budget be for legal representation at this organization. It must be HUGE! The Free Clinic is fighting Jane, fighting the volunteers, investigating charges staff racism (which have been ignored far too long), fighting the staff Union, and they still have the possibility of lawsuits for sexual discrimination and creating a hostile work environment for women at the Free Clinic. Just think of all this wasted money that could be helping individuals in need. If only the Board and administration would do what is right.

Why didn;t anyone from the actual community (non staff, non-volunteer) speak before the board? SHouldn't someone who the Free Clinic's services actually helped be represented? Maybe the Board would feel more pressure to listen and respond?

My thoughts exactly.

I think it has come to that.

Everyone should take a walk on Monday.

The board may have, in their own deceitful way, blown the issue of Jane off, but they forgot the main issue...suffering services, their lack of attention to management, Marty issues, etc.

They haven't, and WILL NOT address those issues without a major walk out.

Come to Friday's meeting for news on any plans for a walkout or strike. We have been discussing plans for this. Word is that it does have Marty worried.

Could someone please post a copy of the letter sent to volunteers regarding the Board meeting on May 31st. It is very interesting when you compare both letter (the reply to Jane and the one to the volunteers).

Honestly, I found it a bit difficult to believe that Marty was such an untrustworthy individual. Now I have my proof to his real nature.

I was also worried about alienating the Board since it was my belief that perhaps they were not fully informed about the goings on at the Free Clinic. I feel so betrayed by these individuals. I now understand just why the clinic is in the state it is in!

I would like to thank the volunteers who came to our Board meeting last week, obviously a lot of time and effort was expended by many of you. Collectively, I believe we all share the ultimate goal of helping the Free Clinic be better able to meet our mission and serve our ever growing constituency. We appreciate all your efforts and discussed your comments at great length during our executive session.

We agree Jane Loisdaughter has made many contributions to the Free Clinic throughout her career. However, after a careful review of all the facts, the Board has voted to uphold Jane's termination for cause. As this is ultimately a personnel matter, it is impossible to publicly provide all the facts in this case without compromising the privacy of the parties involved.

The Board has based its actions on what it has collectively determined is in the best interests of the Free Clinic. We recognize that this decision will not satisfy some volunteers and staff, but hope others will help us move beyond this issue.

The many volunteer letters and meetings drove home the need for some type of formalized relationship between the Board and Free Clinic volunteers. Your ideas, comments and insights should be communicated with us on an ongoing basis as part of our normal decision-making process. As the lifeblood of the Free Clinic, volunteers are major stakeholders in the organization and need a formal role, which provides a venue for open, two-way communication. Thus, I have asked our Human Resources Committee to explore a means of formalizing this relationship and expect to report back to you about this in the next several months. Specifically, many of your ideas regarding strategic team building; workplace environment and staff morale are being addressed right now with staff involvement and guidance from the Human Resources Committee.

I will be working with the Volunteers, Staff, Free Clinic Administration and the Board to develop the appropriate forum for sharing additional thoughts and ideas. We appreciate all your hard work, effort and dedication. We look forward to doing our best to harness all our collective energies to make the Free Clinic as responsive as possible to our expanding role in serving the needs of the community.

The above entry is the letter that Adam sent via email to the volunteer representatives. I find it very interesting that he does not mention that we were a part of a grievance hearing or that we were Jane's agents... In fact, Mr. Fishman does not even use the words "grievance", "agents", or even the milder term "supporters" of Jane's.

The legal definition of "agent" is "one who is authorized to act for another." I did not "act" for Jane at the 5/31 board meeting and I resent Fishman alluding to that in his letter. I am so appalled by the action of this board that I have temporarily ceased to refer my needy patients to the clinic. I cannot in good conscience make referrals which I myself would not be able to follow through on. My faith is still strong in the clinic mission, however, those who are able to uphold that mission appear to be no longer in evidence. My heart breaks to think that this incredible community service is about to be brought down by someone so uncaring to the patient's needs and a board which backs the inappropriate behavior of this horrendous person. kyl

I have known of and supported the mission of the Free Clinic for years. I am somewhat old now and don't have much time left due to failing health. My current will leaves a very considerable amount of money to the Free Clinic. However, after having read about what is going on now, I have set a meeting with my attorney to change my will. I cannot, even in death, support an organization that treats it's clients, volunteers and employees in this fashion. I believe the current administration is not honoring the original mission of the Free Clinic.

Hey! I am a supporter of the Cleveland Indians! I've even been known to attend one of their meetings (games) every once in a while. Should I write to Manny Ramirez or Jim Thome or Omar Vizquel and tell them they owe me ten percent of their salaries since that makes me their agent? Just wondering. LSB

Also just wondering. . .are Fishman's and Hiller's love of money and power and the pursuit of selfishness
so strong that they cannot imagine Jane's supporters offering their energies on her behalf out of a sense of fair play and out of a concern for justice? It appears that loyalty for a comrade who has fought the good fight for twentyfive years is incomprehensible to these men. They can only see negative things in the letters and outcry pouring out on Jane's behalf. As Shakespeare once wrote, goodness and virtue to the vile seem vile. LSB

I sent a letter to the board this past week to clarify the volunteer/agent issue. Here it is:

June 16, 2000

Dear Member of the Board of Trustees
The Free Clinic of Greater Cleveland,

I am writing to you to clarify an obvious misunderstanding.

In a letter to Jane Loisdaughter, dated June 6, 2000, from Adam Fishman, I am mistaken as Jane's agent. I am not Jane's agent. I do not represent her or act on her behalf.

For any board member who has not seen the letter to Jane, I have enclosed it (June 6, 2000). In addition, I have copied the letter sent via email to me from Adam Fishman (June 8, 2000).

It is interesting to note the different tones of each letter. In the letter to volunteers, we are not referred to as "agents", "supporters" or people involved in a "grievance hearing". In the letter to Jane, it's a different story.

The Free Clinic needs our help. As volunteers, whether board members or clinic workers, we need to find common ground and work together to bring Jane Loisdaughter back and help secure the future of the Free Clinic.
