I have to vent and AAC seems the best place to do it.

I am in such turmoil. Please help if you can.

My son's legal case:
Our attorney, in hindsight was extremely unethical. He filed documents with the court AFTER the sentence. He encouraged my son not to go to trial because he said "the police would lie on the stand and that we didn't have a chance." He said the "jurors would all be old folks and Mormon and professionals that we didn't have a chance"...and this was before a jury was even chosen. He lied, did not do any work on this case and charged us thousands of dollars. For over 15 months we were on "high alert", and trusted this attorney to do his job. The a**hole who attacked my son we found out from another attorney was a paid informant and screwed up. The Medical records of this a**hole were reviewed by our expert witness who said that my son had a good defense. The Dr who treated my son for his injuries said my son had no injuries that would indicate that he hurt anyone, but that he was the one that was hurt. Our attorney ignored all information that came in to prove my son's innocence, he poo-pooed it away...oh and he did not do anything about the fact that one of the Sgts. on the police force "lost" an audio tape of my son asking for an attorney because his 'father'died!!! Evidence that was supposed to locked up with a video in the evidence vault at the police station was lost by a policeman (which I doubt)and the video was never produced either...they with held evidence. My attorney supported this!!!!

I have to file a complaint with the State Bar, but if anyone has any other advice I would certainly appreciate it. I am at my wits' end, and I don't want to do what I know I need to do, and that is take this man to task.

I don't have much experience with this or know of what to do......thinking of you & bumping this up.

(((omw))) I'm glad you didn't post this on Libs first, because I never go over there! Glad to hear from you, but sorry that it isn't under better circumstances.

I don't have a lot of experience in this area; however, I definitely think you have reason to file a complaint with the State Bar Association. In my state, there is a form on the website that you can download, fill out, and mail.

I'm not sure if you would be within your rights to file another type of legal action against this attorney to recover any of the fees that you paid to him.

Legal Aid might be a place to begin asking questions without having to pay huge retainers. Or, researching the laws in your state.

Was your son convicted of anything, and what was his sentence if so? I think you would be well within your rights to file an appeal and have an appeals court re-try his case. So many, many things seemed to be overlooked here. Wow...how frustrating for you and your son to have to go through this.

I wish I knew more and could give more specific advice. I wish you luck with this. Don't stop fighting, because our legal system is only as dysfunctional as it is because we don't fight the injustice we see. (((omw)))

I agree file a complaint. if you cna find another attorney hire him and get that other one de barred or what ever.
I agree with ready, file an appeal if you can.

Thank you all for caring and posting. I have been so upset over this. It has been horrible.

I have decided to take a bold stance and then see what happens.

so good to hear from you. Legally, all that happened was illegal. Going up against the system....I want to fight, and there may come a time for that/I feel like blasting them out of the water, I am so angry over the injustice. My son had to take a plea because of the bacward way the system in my town works. Our attorney told us that the police would lie on the stand....like it was ok to do, and because of that we shouldn't go to trial like we had planned on doing and prepared for the entire 15 months...and to make matters worse, as a Paralegal, I know what went wrong, but I trusted him...my entire family trusted him. He just did not do his job. HE charged us a flat fee up front, and he is still now, sending my son bills for additional costs. He actually thiks that he can get away with this? yes he does.

Emotionally, I have to drop it, because as long as I keep it alive so to speak, it is more difficult for him to move forward. Yet, he also knows everything is wrong about this case. I am thinking the best thing to do is send him a letter, and see what happens after that. I may have to go to the State Bar. But everytime I think about everything that happened, I literally become ill. I am torn between how much to pursue and letting most of it go for a later time if necessary. Life is too short to remain in a combative frame of mind...and I have been there most of my adult life in one way or another.
