Dear Martyn -

I read on Destinystar's thread that you are considering applying for S.S. Disability benefits.

Wanted to give you some input on the process. It took me TWO YEARS to win my disability benefits. Social Security turned me down twice. I had to appeal over and over. Finally, I hired an attorney. That is the ONLY way you will win..,. with an experienced attorney.

I had to have an affadavit from my specialist, as well as submitting to examinations by doctors, selected by the S.S. Admin., including a psychologist. It was a long, drawn-out, frustrating procedure. I believe that Horsefly has gone through the same ordeal.

I urge you to start ASAP, be sure you have a specialist who is willing to give a court-reported affidavit on your behalf and hire the best disability lawyer you can find. Make certain you don't hire a firm which represents disability cases, but does not consist of LAWYERS. They are out there. I initially put my case in the hands of one of those bogus firms and all they did was fill in my paperwork (incorrectly) and mail it in on my behalf. Of course, I got turned down twice and they did NOTHING.

This is the best advice I can offer. I wish you well.

Hopefully, others will post with their experiences and input to help you with your case.

Well Ma , You got that right.....I did have a lawyer for my SS . I gave up trying after I was turned down twice....years ago.....I just turned that over easily. It was the dam Worker Comp that I took on by myself without a lawyer......which is unheard of. I won though last year and it stays in appeal for the rest of my life it seems. Someday they will pay......on yeah. If you are thinking about disability people , be ready to have someone to support you or go under a bridge somewhere.....because unless it is life threating...like cancer , kidneys fails, or blindness you will be denied twice and then wait for a hearing for a year..........been there done it and have a very torn t shirt.......(((((Marty))) ((((Ma))) Love you , horsefly

But you can apply asap.....because they count back the days that you were disabled..........somebody told me this and I did it.....a long time ago.....but I did it and look I need it. I really do now .....I did not think it then...but turns out a whole lot different then I imagined. horsefly

I did not have to worry about SS doctors because mind is visible....and lots of clinics.....I went through a charitable Christ Clinic to help me get to a doctor that could help me. Not that I am religious but I do believe in a lot of things............these people diagnosed me which helped me get the help I needed when nobody cared.......It took me one year at that clinic before I saw the specialist . I mean nobody cared or understood......They saved me with the reports. They helped me when I was not able to prove I was under insurance when I got hurt. I was a big ordeal.....I gave up my life , my jobs.......ect. That was how it started with me....I did not have a choice my arm was paralized....I was humbled......horsefly

Oh I forgot , I hated them at first......they actually asked me if they could pray for me......well , they took me into a room and everyone kneeled down to pray for my arm........naturally it freaked me out and I cried and cried. I knew I had a good connection with being a spiritual being and the G I understood. I was freaked out enough losing my arm use and being in a wrist brace forever......this was after 8 months after the horses mauled me. I denied the whole injury because I was so tough and needed my jobs, ........but this was my only way to have medical advise.......I hated them, Now I love them........I could go on and on about this......this is the beginning of my story that I never have said here.....my story could be coming to an ending.........we will see.........Love, horsefly

Well, I took this thread and ran with it. I guess I do that sometimes. It helps me to do that and I don't think it causes anyone any harm.....does it ? Please tell me if it does.........I am learning about you Marty and Ma at the same time.......but I guess I had to express myself about things here. Love, horsefly

I had to apply for my daughter to get SS because of a brain injury and that too took close to 2 years. I had to cart my daughter to all their doctors and get every medical record that exsisted on her. It was a long process but it was worth it, and they go back to the date you were disabled.

Horse: I am SO proud of you....you are talking....and talking affects the brain (teasing) and causes thought process. 🙂 I think that anything that you can do in a positive manner for yourself is ace.

back to the thread.....
I do have some questions for you guys...where do I start...would you suggest STARTING at a lawyer? I don't know squat about this...do I go to the SS offfice first (wow, that sounds like I am visiting someone in jackboots....kidding) Also...may I give you a run down of my difficulties...just to see if you think it is worth it? I originally went to a neurologist...had a herniated disk...when they went in they found out that I had loads of bone growth that was compressing the spinal column...the ortho guy said that my surgery was in his words "gruesome"...they put in a titanium plate...the neuro guy told me that I had two more ruptured disks above and below...but that they were afraid to operate until I turned 50...because of the risks of paralysis. I am on pain management. I find it difficult to do simple things like...type (eek!) write for any length of time, and doing simple chores around the house puts me in a neckbrace with meds. I have not seen the neuro guy since the surgery. BEFORE the surgery I had to be cleared cardio wise due to a problem with my EKG. It was then that they found out that I had Tricuspid Valve Regurgitation. The cardiac guy told me that I was cleared for surgery, although he was a bit nervous about it, but he said that as long as I kept an eye on myself, that I would probably be okay. In addition to that I have osteoarthritis in my neck, knees, and other joints...hypothyroidism, bipolar disorder, and high blood pressure. DO you think that it is possible to get SSI? I mean, do you think that it is worth it for me to try? I am asking your opinion....I know that it is up to me to decide (smile).
I have been trying to go online to find out info. Thanks so much for your help.....and to NETSIRK....I can not possibly imagine what it must be like to deal with the ilness of a child....what courage. ((HUG)))

ps....what doc should I start with? I can still go to the neuro guy....but I don't remember the cardiac guy's name....should I go to a new specialist and start over? What sort?

I would start with getting the application from SS and start working on that from your end. As far as a lawyer I checked in the yellow pages for ones that worked with SS cases and then found one hat was willing to give us break since we were dealing with a child.

You can get teh application online or from your local SS office.

Martyn- Please go to the Social Security.gov web site. It will tell you all that you need to know in regards to qualifying for benefits.

Briefly it has to be a disability that is permanent and expected to last over a year. That prevents you from working. If you have not been working for over a year and have MD's send in all your records an evaluator will take the first step and look at your info and make a decsion.

The first step is to call social security 1-800 number and make an appointment.

Thanks Dest....I have checked the SS website before...but I wanted to know sort of how it is in the real world when you apply. You guys are great...thank you so much for all of the great info! I will go back and check it as well... now I know a bit more...which is great!!! I am going to discuss it with my doc tomorrow as well and see what he thinks...I have been out of work for about a year and four months.

I just remembered that our county office had a list of local lawyers that helped people obtain SS. My daughter had to get Medical Assistance in order to get SS but that gave us a county social worker who helped with the SS. I hope that helps.

Marty, I just called the local S.S. office and they interview me over the phone......they sent me the papers in the mail. I just just kept up with the forms myself and was denied twice. They do that anyway......then I got a lawyer. I collected medical reports of the ER and everywhere. But I strongly advise getting a lawyer for this...because you will get lost in the cracks of the system. I almost did with a lawyer. But you can do this by just calling them and they will send you the forms. That is how I did it...... you cannot be working.....at all though...SSI is a supplement you can get according to your situation. Like me, I get it for a few months until the S.S. kicks in.........it is all complicated as hell and I still don't understand it all.......I don't think they do either. Love, horsefly

Get a lawyer BEFORE you fill in their forms/paperwork. How you word each and every answer is critically important. And there will be ALOT of forms to complete. TONS. And they "duplicate" the questions asked, over and over for a year or more. Be patient, but -- most importantly -- have the LAWYER help you complete the endless forms, so you don't blow your claim by phrasing anything incorrectly.

Be prepared for psychological evaluation, as well as physical.
